Lawsuit Abuse Impact

America's runaway legal system imposes burdensome costs on workers, consumers, small businesses, and healthcare. The cost of America's lawsuit-happy culture totals $261 billion a year, or $880 per person, according to seminal research by Tillinghast-Towers Perrin (2006). According to a 2007 study commissioned by the Institute for Legal Reform, small businesses alone pay $98 billion a year to cover the cost of America's tort system -- money that could be used to hire additional workers, expand productivity, and improve employee benefits.

Lawsuit abuse also has a damaging impact on healthcare. In some areas of the country, medical liability lawsuits have driven malpractice insurance rates through the roof, driving doctors from their practices and closing trauma centers and emergency rooms across the country. The American Medical Association reports that there are now 17 states in a full-blown medical liability crisis.

Bipartisan Poll Shows Small Businesses Concerned About Economy, Lawsuits, Effectiveness of Government Actions

Key Data From a National Survey of Small BusinessesFrom August 19-31, 2010, Public Opinion Strategies and Douglas Schoen LLC completed 1,000 interviews with individuals who identified themselves as the owner, president, partner, CEO, financial officer or VP/Senior manager at a private company with fewer than 500 employees as per SBA designations for certain small businesses. Ninety-six percent (96%) had fewer than 100 employees, and a majority (58%) had 2-5 employees. Respondents’ companies represented a wide range of industries and were located throughout the country. Interviews were conducted both on-line (N=400) and via telephone (N=600) to ensure a wide range of types of businesses and individuals. Download Now

Small businesses are the engine of job growth in this country.  At a time when unemployment rates are high, it is important to understand the forces that impair the ability of small businesses to thrive and grow. This report contains the findings of a study that estimates the tort liability costs that fall on small businesses. Lawsuit Climate 2010: Ranking the StatesThe 2010 State Liability Systems Ranking Study was conducted for the U.S. Chamber Institute for Legal Reform to explore how reasonable and balanced the states’ tort liability systems are perceived to be by U.S. business.
